Terms of Service

These Terms of Service ("Terms") govern access to and use of ChatGenio, an AI chat and lead-response platform operated by M Genio ("ChatGenio," "we," "us"). By creating an account, configuring ChatGenio for a website or social channel, or otherwise using the service, you agree to these Terms on behalf of yourself and the business you represent.

The service

ChatGenio lets a business deploy an AI assistant on its website, and optionally on Messenger, Instagram, and WhatsApp, that answers visitor questions using the business's own content, captures and books leads, and can hand a conversation off to a live human agent.

Accounts and client responsibilities

• You're responsible for the accuracy of the content, credentials, and configuration you provide to ChatGenio, and for keeping login and integration credentials secure.
• You're responsible for your own compliance obligations toward your website visitors and customers — including providing your own privacy notice and obtaining any consent required in your jurisdiction for the channels you enable.
• You retain ownership of the content, knowledge base material, and conversation data associated with your account.
• You must have the rights necessary to connect any third-party channel or integration (e.g. a Facebook Page or Instagram account you administer) to ChatGenio.

Acceptable use

You agree not to use ChatGenio to:

• Send unlawful, deceptive, abusive, or harassing content to visitors.
• Violate the terms or policies of any connected platform (including Meta's Platform Terms and Community Standards, Slack's, or HubSpot's).
• Attempt to reverse engineer, scrape, or circumvent the security of the ChatGenio platform or widget.
• Use the service in a way that infringes on the rights of others or violates applicable law.

AI-generated responses

ChatGenio's responses are generated by AI models and are provided to assist, not to serve as professional, legal, medical, or financial advice. Responses may occasionally be inaccurate or incomplete. Human agent availability for live handoff depends on your own staffing and is not guaranteed by ChatGenio.

Fees

Use of ChatGenio is subject to the pricing and payment terms agreed with M Genio at signup. Fees are non-refundable except as required by law or as otherwise agreed in writing.

Intellectual property

M Genio retains all rights to the ChatGenio platform, software, and branding. Nothing in these Terms transfers ownership of that platform to you. You retain ownership of your own business content and data.

Termination

Either party may terminate use of the service as agreed in your subscription arrangement, or where either party materially breaches these Terms and fails to cure within a reasonable period after notice. On termination, we will make your account data available for export for a reasonable period, after which it may be deleted per our data retention practices.

Disclaimer and limitation of liability

ChatGenio is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, M Genio is not liable for indirect, incidental, or consequential damages arising from use of the service, and our total liability for any claim is limited to the fees paid for the service in the 12 months preceding the claim.

Governing law

These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law principles, unless a separately signed agreement between you and M Genio states otherwise.

Changes to these Terms

We may update these Terms as ChatGenio evolves. Material changes will be reflected by updating the date at the top of this page.
